The Association of Apartment Owners of Waikiki Banyan, Inc. is a nonprofit corporation in the State of Hawai`i under Hawaii Revised Statutes Chapter 415B.

Waikiki Banyan’s Board of Directors consists of nine unit owners serving staggered three-year terms. Each year at least three director’s positions are open for election at the Association’s Annual Meeting.

 

Our Articles of Incorporation were filed August 8, 2000, pursuant to the written approval of the Association members.

 

Waikiki Banyan operates under the provisions of Hawaii Revised Statutes Chapter 514B, the recodification of 514A. Under the legal umbrella of HRS 514B we are governed by the following documents.

 

the First Restatement of the Declaration of Condominium Property Regime of Waikiki Banyan, Fifth Amendment, the most general document that establishes our overall administrative framework and includes the By-Laws.

 

Exhibits A through D, attached to the Declaration to provide detailed information on the location and configuration of the property and apartments.

 

Exhibit E to the Declaration, the By-Laws establish how the Association of Apartment Owners is to govern itself.

 

The most specific of our documents, the House Rules describe in detail various procedures and regulations governing our day-to-day operations. Revised 2012.

Waikiki Banyan was developed pursuant to the terms of the Master Lease between the landowners and the developer, Banyan One, Inc., and the Master Sublease between Banyan One, Inc. and Waikiki Banyan, Inc.

the original lease between the landowners (Liliu`okalani Trust and Kawaiahao Church) and the developer of Waikiki Banyan (Banyan One, Inc., later Sammar Properties).
